Please read these Terms of Service carefully before using GetCookie. By accessing or using our Service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing, downloading, installing, or using GetCookie (the “Service”), including through our Discord bot, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of Service

GetCookie is a community recognition service that operates through our Discord bot. The Service enables users to:

• Give Cookies to community members to acknowledge great contributions
• Receive Cookies as recognition from others
• View leaderboards showing recognition activity
• Track engagement and community health

3. Eligibility

By using the Service, you represent and warrant that:

• You are at least 13 years of age (or the age required by Discord’s Terms of Service in your jurisdiction)
• You have the authority to agree to these Terms
• Your use of the Service complies with all applicable laws and regulations
• You are authorized to use the Discord server where GetCookie is installed

4. User Conduct

By using the Service, you agree to:

• Use the Service only for its intended purpose of community recognition
• Not abuse, spam, or misuse the recognition system
• Not use the Service to harass, bully, or harm others
• Not attempt to manipulate leaderboards or game the recognition system
• Not use bots or automated systems to interact with the Service
• Not attempt to gain unauthorized access to the Service or its systems
• Comply with Discord’s Terms of Service and Community Guidelines

4.1 Prohibited Activities

You agree NOT to:

• Give Cookies as part of any fraudulent scheme
• Use the Service for money laundering or illegal financial activities
• Sell, trade, or exchange Cookies outside of official Service features
• Impersonate others or create fake accounts
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code from the Service

5. Cookies and Rewards

5.1 Nature of Cookies

Cookies are digital tokens representing recognition within the GetCookie system. They may have real value and can be redeemed for rewards where such features are available.

5.2 No Guarantee of Value

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE VALUE OF COOKIES.

• Cookie values may fluctuate
• There is no guarantee Cookies can be redeemed for any specific value
• Reward availability may change at any time

6. Server Administrator Responsibilities

If you are a Discord server administrator who has installed GetCookie:

• You are responsible for configuring the Service appropriately for your community
• You are responsible for ensuring users in your community comply with these Terms
• You may remove GetCookie from your server at any time
• You are responsible for any community values or custom settings you configure

7. Intellectual Property

The Service, including its design, features, and content, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Disclaimers

8.1 No Warranty

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, GetCookie disclaims all warranties, including:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding uninterrupted or error-free operation
• Warranties regarding the accuracy of leaderboards or recognition data

8.2 Service Availability

We do not guarantee that the Service will be available at all times. The Service may be interrupted for maintenance, updates, or unforeseen circumstances.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETCOOKIE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of Cookies or recognition data
• Any damages resulting from third-party services or platforms
• Any damages resulting from unauthorized access to your account

IN ANY CASE, TOTAL LIABILITY SHALL NOT EXCEED ONE U.S. DOLLAR ($1.00 USD).

10. Indemnification

You agree to indemnify and hold harmless GetCookie from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or recognition messages you send through the Service

11. Termination

We may terminate or suspend your access to the Service at any time, without notice, for any reason, including:

• Violation of these Terms
• Abusive or fraudulent behavior
• Extended inactivity
• Discontinuation of the Service

Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetCookie regarding the Service.
